Terms of Service

Effective date: August 7, 2026

These Terms of Service govern the media production services Mantis 3D provides to its clients. By booking a shoot, accepting an estimate, or using media we deliver, you agree to these terms. If you are booking on behalf of a brokerage or company, you confirm you are authorized to do so.

Our Services

Mantis 3D produces real estate media, including photography, video, drone footage, 3D virtual tours, floor plans, and related content for residential and commercial listings across Orange County and Los Angeles. The specific deliverables, turnaround, and price for your project are set out in the estimate or booking confirmation we send you. Prices and package inclusions are described on our pricing page and service pages.

Scheduling and Access to the Property

Shoots are booked for a scheduled date and arrival window. So we can capture the property fully, please make sure that:

• The property is photo-ready before our arrival, including cleaning, staging, and clearing clutter. Our team does not clean or stage, though we may make minor adjustments on site.
• We have access to the property and to every area to be photographed at the scheduled time, including any gates, lockboxes, or entry codes.
• Occupants, tenants, and pets are notified and, where needed, off site or secured during the shoot.
• Lights are working and any known access issues are shared with us in advance.

If the property is not ready on arrival, or if we cannot access it within the scheduled window, we may reschedule the shoot, and a return trip may be treated as a new booking.

Weather and Outdoor Sessions

Some services depend on weather and daylight, including drone flights and twilight sessions. Drone operations also follow FAA rules and airspace restrictions. When weather or airspace prevents safe capture, we will reschedule the affected part of the shoot for the next available window. Twilight sessions are scheduled as a separate evening visit.

Rescheduling and Cancellation

If you need to reschedule or cancel, let us know as early as possible so we can adjust our schedule. Cancellations or reschedules made on short notice, or a shoot that cannot proceed because the property is not accessible or ready, may be subject to a fee that covers the reserved time and travel. The notice window and any fee that applies to your booking are stated on your estimate or booking confirmation.

Payment

Payment is due as stated on your estimate or invoice. We deliver final media once payment is complete. Fees for the services you book, along with any applicable taxes and travel surcharges, are set out in your estimate. If an invoice is not paid when due, we may hold delivery and pause any license to use the media until the balance is settled.

Travel

Our published prices are Orange County base rates. Properties outside Orange County carry a travel surcharge based on distance, which appears on your estimate and is summarized on our pricing page. Shoots beyond our standard service radius are quoted individually.

Twilight Revisit Credit

Packages that include a twilight revisit session cover real twilight photography and twilight video captured in a single evening visit. Where twilight capture does not apply to a property, such as some condos, a credit is applied toward other a la carte services as described in your package.

Use of Delivered Media

Mantis 3D retains the copyright to all media we create. When your project is paid in full, we grant you a license to use the delivered media to market the specific listing it was created for and to promote your own real estate brand. This includes the MLS, listing portals such as Zillow, your website, social media, print marketing, and email.

This license is personal to you and your brokerage. Unless we agree otherwise in writing:

• Media may not be resold, sublicensed, or transferred to another agent, brokerage, builder, or third party. When a listing involves more than one party who wants to use the media, each party arranges their own license with us.
• Media should not be materially altered in a way that misrepresents the property.
• The license continues after a listing closes, for your ongoing portfolio and brand use, subject to these terms.

Mantis 3D keeps the right to use the media in its own portfolio, website, social media, advertising, and marketing materials. If a property owner asks that their home not appear in our marketing, let us know and we will honor the request.

Image Disclosure (California AB 723)

Some services, such as virtual twilight and virtual staging, produce digitally altered images. California law requires that these alterations be disclosed, and we include the required disclosure on delivery for any altered images.

Select images may include digital sky or twilight enhancement and/or virtual staging. These alterations are disclosed on delivery in accordance with California law, effective January 1, 2026.

Limitation of Liability

We take care to deliver professional media, and we will re-shoot or correct work that does not meet the scope of your booking. Beyond that, our services and media are provided as is. To the fullest extent allowed by law, Mantis 3D is not liable for indirect, incidental, or consequential damages, and our total liability for any claim related to a project is limited to the amount you paid for that project. We are not responsible for the sale, valuation, or marketing outcome of any listing.

Governing Law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to our services will be handled in the state or federal courts located in Orange County, California.

Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will change the effective date at the top of this page. The terms in effect when you book apply to that booking.
